1. Acceptance of Terms

By downloading, installing, accessing, or using the FishPilot mobile application ("App") or visiting our website at fishpilot.app ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Website.

You must be at least 18 years old to use FishPilot. If you are under 18, you may only use FishPilot with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms.

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of FishPilot after such modifications constitutes your acceptance of the updated Terms.

FishPilot is an informational tool designed to help recreational anglers by providing:

Geographic Scope

FishPilot is intended for use within the United States. Regulation information is provided for 7 states and federal waters. We make no representations about accuracy, completeness, or availability of information for fishing outside the United States. Users outside the US may access FishPilot, but do so at their own risk and without any guarantee of service or support.

FishPilot is an informational tool only. It does NOT provide legal, regulatory, wildlife management, or professional advice. All information is provided for general informational and educational purposes only. FishPilot is NOT a substitute for consulting official government sources, state fish and wildlife agencies, or qualified legal professionals.

3. Regulation Information Disclaimer

IMPORTANT: Read This Section Carefully

Fishing regulations are complex, change frequently (sometimes without advance notice), and vary significantly by:

  • State and local jurisdiction
  • Specific water body (lake, river, bay, offshore zone)
  • Species
  • Season and time of year
  • State waters vs. federal waters
  • Commercial vs. recreational fishing
  • Emergency closures and special management areas

FishPilot may display regulation information that is incomplete, outdated, inaccurate, or incorrect. We make reasonable efforts to provide current information, but we cannot guarantee accuracy, completeness, timeliness, or reliability of any regulation data displayed in the App.

YOU MUST verify ALL fishing regulations with official sources before fishing, keeping, or harvesting any fish. Official sources include your state's fish and wildlife agency (such as FWC, TPWD, LDWF, etc.) and NOAA Fisheries for federal waters.

Emergency closures, recent regulatory changes, special restrictions, and local ordinances may not be reflected in FishPilot. The absence of a restriction in FishPilot does not mean no restriction exists.

4. AI Fish Identification Disclaimer

AI Limitations

FishPilot uses artificial intelligence technology to analyze photographs and suggest fish species identifications. AI-generated identifications may be inaccurate, incomplete, or wrong.

AI technology has inherent limitations. Factors affecting accuracy include photo quality, lighting, angle, fish condition, and similarities between species. The AI may confuse similar-looking species, some of which may have vastly different regulations (including protected species with zero harvest limits).

You should NEVER rely solely on AI identification when deciding whether to keep a fish. Always verify species identification through:

Misidentification of fish species can result in serious legal consequences, including fines, criminal charges, and loss of fishing privileges.

4a. Personalized Analysis and Scores -- Not Predictions

FishPilot may display personalized fishing analysis, including condition scores, pattern analysis, forecasts, and coaching suggestions. These features:

Scores, percentages, and rankings displayed in the App (including but not limited to condition scores, pattern match scores, weekly forecasts, and comparative rankings) are generated from limited datasets and proprietary algorithms. They are not statistically validated predictions and no particular outcome is guaranteed or implied.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

We are not liable for any losses or damages arising from unauthorized access to your account due to your failure to protect your credentials.

7. Liability for Fines and Enforcement Actions

FishPilot, its owners, operators, employees, and affiliates are NOT responsible for any:

  • Citations or tickets
  • Fines or monetary penalties
  • Criminal charges or prosecution
  • License suspensions or revocations
  • Equipment or catch confiscation
  • Civil penalties
  • Any other enforcement actions

You assume full and sole responsibility for complying with all applicable fishing laws and regulations. FishPilot bears no liability for any consequences resulting from your reliance on information provided in the App.

You agree to defend, indemnify, and hold harmless FishPilot, KinCompass Labs LLC, and their respective officers, directors, employees, agents, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

11. Assumption of Risk

Fishing and outdoor activities involve inherent risks, including but not limited to risks of injury, drowning, wildlife encounters, weather hazards, and equipment failure. By using FishPilot in connection with fishing activities, you acknowledge these risks and assume all responsibility for your safety and the safety of others.

FishPilot is not responsible for any harm, injury, death, or property damage that may occur in connection with your fishing activities, regardless of whether you used information from FishPilot.

12. Subscriptions and Billing

Subscription Tiers

FishPilot offers both free and premium subscription tiers. Premium features require an active paid subscription. New subscribers receive a 7-day free trial.

Billing

Premium subscriptions are billed on a recurring basis. All payments are processed through Apple App Store or Google Play Store ("App Stores"). You authorize the applicable App Store to charge your chosen payment method.

Auto-Renewal

Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You may cancel your subscription at any time through your App Store account settings. Cancellation will take effect at the end of the current billing period. No refunds are provided for partial billing periods.

Refunds

All refund requests must be submitted to the applicable App Store (Apple or Google). FishPilot does not directly process refunds. Refund eligibility is determined by the App Store's refund policies.

Price Changes

We reserve the right to change subscription prices. We will provide advance notice of price changes. Continued subscription after a price change constitutes acceptance of the new price.

13. Third-Party Services

FishPilot uses third-party service providers for various functions including authentication, cloud storage, analytics, and AI image processing. These third-party services have their own terms of service and privacy policies.

AI Processing Disclosure

Photos you submit for fish identification are sent to Anthropic's AI service (Claude API) for species identification. Anthropic processes photos under our data processing agreement and does not use your photos to train their general models. We encourage you to review the privacy policies of our AI service providers.

FishPilot also uses third-party services for cloud storage (Google Firebase), authentication, and environmental data (NOAA, OpenWeatherMap). Each has their own privacy policies. FishPilot is not responsible for the actions, content, information, or practices of any third-party services.

Data Retention by Third Parties: Once photos or data are transmitted to third-party services, we cannot guarantee deletion of that data even if you delete your FishPilot account. Third-party providers maintain their own data retention policies.

14. User Content

You retain ownership of photos and content you submit to FishPilot. By submitting content, you grant FishPilot a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, copy, process, store, transmit, modify, create derivative works from, and analyze your content for the following purposes:

This license continues even if you stop using FishPilot or delete your account, but only for content that has already been incorporated into our systems or used for model training prior to deletion.

You represent that you have all necessary rights to submit content and that your content does not violate any laws or third-party rights.

Aggregate and Anonymized Data

We may create and use aggregate, anonymized, or de-identified data derived from your content and use of FishPilot for any purpose, including analytics, research, marketing, and improving our services. This data cannot reasonably be used to identify you.

Feedback and Suggestions

Any feedback, suggestions, ideas, or other information you provide about FishPilot ("Feedback") becomes our exclusive property. We may use, reproduce, modify, and commercialize Feedback without any obligation, compensation, or attribution to you. You waive any rights you may have in such Feedback.

14a. Community Intelligence

FishPilot provides Community Intelligence features -- aggregate fishing activity data derived from anonymized catch data contributed by FishPilot users.

How Community Intelligence Works

Your Participation

Community Intelligence data is approximate, may not reflect current conditions, and should not be relied upon for fishing decisions. See our Privacy Policy for full details on data anonymization.

14b. Affiliate Content and Advertising

FishPilot may display gear recommendations, product suggestions, and technique tips that contain affiliate links. When you purchase products through these links, we may earn a commission at no additional cost to you.

Affiliate content is clearly labeled within the App. Product recommendations may be personalized based on your fishing patterns and catch history. The presence of affiliate links does not affect the editorial integrity of our fishing tips and educational content.

We may also display sponsored content from fishing brands, which will be clearly labeled as "Sponsored" or "Paid Partnership."

15. Intellectual Property

FishPilot, including its content, features, functionality, software, and trademarks, is owned by KinCompass Labs LLC and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use FishPilot for personal, non-commercial purposes in accordance with these Terms.

16. Termination

We may suspend or terminate your access to FishPilot at any time, with or without cause, with or without notice. Reasons for termination may include violation of these Terms, fraudulent activity, or conduct harmful to other users or our services.

You may delete your account at any time through the App settings.

Upon termination, your right to use FishPilot ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

17. Dispute Resolution -- Mandatory Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

(a) Agreement to Arbitrate

You and KinCompass Labs LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the App, or your use of the App (collectively, "Disputes") will be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring claims in small claims court if eligible.

(b) Arbitration Rules

Arbitration will be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will take place in the State of Florida or, at your election, by telephone or video conference. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You may opt out of this arbitration agreement by sending written notice to legal@fishpilot.app within 30 days of first accepting these Terms. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of the arbitration provision. If you opt out, you and KinCompass Labs LLC agree to submit to the exclusive jurisdiction of the state and federal courts located in the State of Florida.

(e) Severability

If the class action waiver in this section is found to be unenforceable, the entire arbitration agreement shall be void. All other provisions of these Terms shall remain in effect.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. If arbitration is not applicable, you consent to the exclusive jurisdiction and venue of the state and federal courts located in the State of Florida.

18. Service Availability

FishPilot is provided on an "as available" basis. We do not guarantee that FishPilot will be available at all times or without interruption. We may:

We are not liable for any damages or losses resulting from service unavailability or interruptions.

19. Beta and Experimental Features

We may offer beta, preview, or experimental features ("Beta Features") to test new functionality. Beta Features:

Your use of Beta Features is at your sole risk. We welcome feedback on Beta Features but are under no obligation to implement suggestions or continue offering any Beta Feature.

20. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FishPilot regarding your use of the App and Website.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights hereunder. We may assign our rights and obligations without restriction.

Force Majeure

We are not liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, epidemics, acts of God, war, terrorism, riots, civil unrest, government actions or orders, labor disputes, internet or telecommunications failures, power outages, cyberattacks, or failures of third-party service providers.
